Terms of service
Effective date: September 30, 2026
These Terms and Conditions (“Terms”) apply to your use of getcustompack.com, your GetCustomPack customer account, and purchases from GetCustomPack (“we,” “us,” or “our”). Please review these Terms and the specifications and policies presented with your order before purchasing. By placing an order or using our services where these Terms are presented for acceptance, you agree to them. Nothing in these Terms limits rights that applicable law does not allow us to exclude.
1. Eligibility and customer accounts
You must be legally able to enter into a contract to place an order. If you order for a business or another organization, you confirm that you have authority to act on its behalf. Provide accurate contact, billing, shipping, and order information, and keep your account information current.
Keep your sign-in methods secure and notify us promptly if you suspect unauthorized account use. You may use available third-party sign-in options, including Google, subject to the provider’s authentication process. Our store and customer accounts are powered by Shopify. How personal information is collected and used is described in our Privacy Policy. Signing in does not by itself require consent to promotional emails.
2. Products, specifications, and intended use
We offer packaging products, including products made to a customer’s selected dimensions, materials, quantities, and artwork. Review your selections carefully. The product description, approved specifications, accepted quotation, and any approved proof identify what we will produce for your order.
Images, digital previews, and on-screen colors are representations; displays, printing processes, and materials can affect appearance. Any material production tolerances or substitutions must be disclosed or agreed with you. This paragraph does not excuse products that fail to conform to agreed specifications or applicable legal requirements.
Tell us before ordering if your packaging must meet specific performance, food-contact, labeling, regulatory, shipping, or other requirements. Do not assume a product is suitable for a regulated or specialized use unless its description or our written confirmation establishes that suitability. You are responsible for the accuracy and legality of content you ask us to print.
3. Prices, quotations, and payment
Prices and available options may change before an order is accepted. Prices are in U.S. dollars unless another currency is identified. Applicable taxes, shipping charges, and other disclosed charges are shown at checkout or in the quotation you accept. A quotation is subject to any validity period and conditions stated in it.
You authorize charges for the order amount you approve using your selected payment method. Any different payment schedule must be agreed in writing. We will not impose additional charges for a material change to your order without your agreement. If an error affects pricing, availability, or a material description, we will contact you to resolve it; if we cannot fulfill an order you have paid for, we will provide the refund required by applicable law.
4. Orders and acceptance
Submitting an order is an offer to purchase. An automated receipt confirms that we received your submission; acceptance occurs when we expressly confirm acceptance or begin fulfilling the order. We may decline an order before acceptance for reasons such as unavailable materials, payment issues, suspected fraud, or content we cannot lawfully produce. If we decline a prepaid order, we will refund the amount paid for that order.
A separate written agreement expressly accepted by both parties may establish different terms for a particular order. Its specific order terms control if they conflict with these general Terms, subject to applicable law.
5. Artwork and intellectual property
You retain your rights in artwork and other materials you provide. You confirm that you own those materials or have permission to use and reproduce them for the requested order, including any logos, trademarks, photographs, or designs belonging to others.
You give us and the service providers involved in fulfilling your order a limited, non-exclusive permission to process, reproduce, and use those materials as necessary to prepare proofs, manufacture, deliver, and support your order. This permission does not transfer ownership of your artwork or authorize us to use it in public advertising without separate permission. Our website, branding, tools, and other materials remain the property of their respective owners.
6. Proofs and production approval
When a proof or final specification is provided for approval, review spelling, layout, artwork placement, dimensions, materials, quantity, and other shown details before approving it. Approval authorizes production according to the approved proof and specifications. Contact us before approval if a physical sample or another form of verification is necessary for your use.
Changes after approval may affect price and timing and may no longer be possible once production has begun. We will explain any proposed changes to cost or schedule for your approval. Your approval does not release us from responsibility for our own production errors or products that do not meet the agreed specifications.
7. Production, shipping, and delays
Production and shipping timing is stated with your order or quotation. Where expressly disclosed before purchase, timing may depend on receiving required payment, usable artwork, specifications, and proof approval. A carrier’s transit estimate is not a guaranteed delivery date unless we expressly agree otherwise.
If we cannot meet a stated shipment timeframe, we will notify you and provide the revised timing and cancellation or refund options required by applicable law. We will obtain consent to a delay when required. Events outside our reasonable control do not remove your statutory cancellation or refund rights.
Please provide a complete, accurate delivery address and any relevant delivery requirements. Contact us promptly about a missing shipment or transit damage so we can help investigate. Responsibility for loss or damage will be determined by the applicable order agreement and law; these Terms do not automatically shift all transit risk to you when goods are handed to a carrier.
8. Changes, cancellations, and returns
To request a change or cancellation, contact info@getcustompack.com as soon as possible with your order number. We will confirm the production status and whether the requested change or cancellation can be accommodated. A request alone does not confirm that an order has been changed or cancelled.
Custom manufacturing can limit the ability to change, cancel, or return an order once work has begun. Any non-refundable charges, cancellation fees, or return restrictions must have been clearly disclosed and agreed before purchase and must be permitted by law. These Terms do not create an undisclosed restocking fee or a blanket “no refunds” policy. Any separate return policy clearly presented with your purchase also applies, subject to your mandatory legal rights.
Contact us before sending goods back so we can provide appropriate instructions. Nothing in this section limits remedies for defective, incorrect, or nonconforming goods, or cancellation and refund rights required by law.
9. Problems with an order
Inspect your delivery and report any damage, shortage, incorrect product, or production concern promptly. Include your order number, a description, and photographs where reasonably available. Keep the products and packaging while we review the issue, when practical.
We will assess the issue against the agreed order specifications and applicable law and work with you on an appropriate remedy, which may include correction, replacement, or refund. Reporting promptly helps us investigate; this request does not impose a shortened statutory claim period or remove rights you otherwise have.
10. Acceptable use and third-party services
Do not misuse our website or accounts, impersonate another person, submit unlawful or infringing content, distribute malicious code, interfere with security, or attempt to access another customer’s information. We may restrict access reasonably necessary to address fraud, security threats, unlawful activity, or material misuse. Doing so does not remove our obligations concerning accepted orders or refunds required by law.
Links, payment services, sign-in providers, and other third-party services may be governed by their own terms. We do not control those third-party websites or services. Their involvement does not remove our responsibility for our own products or obligations under applicable law.
11. Warranties and responsibility
Any specific product warranty we offer will be stated with the product or order. We do not promise that the website will always be available or error-free. To the extent permitted by law, we are not responsible for losses caused solely by third-party websites or circumstances outside our reasonable control.
Nothing in these Terms excludes or limits a warranty, remedy, or liability that cannot lawfully be excluded or limited, including applicable consumer protections. These Terms do not disclaim responsibility for fraud, willful misconduct, gross negligence, or our failure to supply products as agreed where the law does not permit such a disclaimer.
12. Governing law and resolving concerns
These Terms are governed by the laws of California, United States, except where applicable law requires otherwise. If you are a consumer, any mandatory protections and rights to bring a claim in a legally available forum remain in effect. These Terms do not require arbitration or waive participation in a class action.
Please contact us first if you have a concern so we have an opportunity to resolve it. This request does not restrict your right to use any remedy available under applicable law.
13. Changes and general provisions
We may update these Terms for future use and future orders by posting a revised version with a new effective date and providing additional notice where required. The version accepted for an order continues to govern that order unless you agree to a change or the law requires otherwise.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later. These Terms, the applicable order details, and any separate written agreement accepted by both parties form the agreement for the services and purchases they cover.
